《中華人民共和國(guó)招標(biāo)投標(biāo)法》已由中華人民共和國(guó)第九屆全國(guó)人民代表大會(huì)常務(wù)委員會(huì)第十一次會(huì)議于1999年8月30日通過，現(xiàn)予公布，自2000年1月1日起施行。

第一章  總則
第一條  為了規(guī)范招標(biāo)投標(biāo)活動(dòng)，保護(hù)國(guó)家利益、社會(huì)公共利益和招標(biāo)投標(biāo)活動(dòng)當(dāng)事人的合法權(quán)益，提高經(jīng)濟(jì)效益，保證項(xiàng)目質(zhì)量，制定本法。
第二條  在中華人民共和國(guó)境內(nèi)進(jìn)行招標(biāo)投標(biāo)活動(dòng)，適用本法。
第三條  在中華人民共和國(guó)境內(nèi)進(jìn)行下列工程建設(shè)項(xiàng)目包括項(xiàng)目的勘察、設(shè)計(jì)、施工、監(jiān)理以及與工程建設(shè)有關(guān)的重要設(shè)備、材料等的采購，必須進(jìn)行招標(biāo)：
（一）大型基礎(chǔ)設(shè)施、公用事業(yè)等關(guān)系社會(huì)公共利益、公眾安全的項(xiàng)目；
（二）全部或者部分使用國(guó)有資金投資或者國(guó)家融資的項(xiàng)目；
（三）使用國(guó)際組織或者外國(guó)政府貸款、援助資金的項(xiàng)目。
前款所列項(xiàng)目的具體范圍和規(guī)模標(biāo)準(zhǔn)，由國(guó)務(wù)院發(fā)展計(jì)劃部門會(huì)同國(guó)務(wù)院

Chapter I General Provisions
The first order to standardize the bidding activity, to protect national interests, public bidding activities, interests and legitimate rights and interests, enhance economic efficiency, to ensure the quality of projects with law.
The second bidding in the PRC to conduct activities in this Law.
Article in the PRC include the following construction project survey, design, construction, supervision and construction and engineering of important equipment, materials procurement, to tender:
(A) large-scale infrastructure, public utilities such as social and public interests, public safety projects;
(B) use all or part of the state-owned investment funds or national financing;
(C) the use of international organizations or foreign government loans, aid funds.
The specific items listed in the preceding paragraph, the scope and scale of the standard, by the State Council department in conjunction with the State Council Development Plan
