新頒《招標(biāo)投標(biāo)法》第五條規(guī)定“招標(biāo)投標(biāo)活動(dòng)應(yīng)當(dāng)遵循公開、公平、公正和誠實(shí)信用的原則”;第三十三條規(guī)定:“投標(biāo)人不得以低于成本價(jià)的報(bào)價(jià)競標(biāo)”;第四十一條規(guī)定中標(biāo)人的投標(biāo)應(yīng)符合“滿足招標(biāo)文件的實(shí)質(zhì)性要求,并經(jīng)評(píng)審的投標(biāo)價(jià)格最低”;但是投標(biāo)價(jià)格低于成本價(jià)除外氣顯然,這些條文規(guī)定了招投標(biāo)過程中價(jià)格的形成與確定原則,并且反映了我國工程造價(jià)的管理模式、計(jì)價(jià)辦法進(jìn)一步改革的指導(dǎo)思想,其實(shí)質(zhì)內(nèi)容就是“公平競爭,合理低價(jià)中標(biāo),但不低于成本價(jià)”。
根據(jù)國家規(guī)定,我省各地、市建設(shè)行政管理部門已先后在建設(shè)工程招投標(biāo)交易市場推行了“經(jīng)評(píng)審的最低價(jià)得分最高”、“合理低價(jià)中標(biāo)”的評(píng)標(biāo)、定標(biāo)辦法。但是由于招投標(biāo)主體自身因素的影響和現(xiàn)行工程造價(jià)的計(jì)價(jià)辦法的制約,在評(píng)標(biāo)時(shí)經(jīng)常會(huì)出現(xiàn)難以界定最低報(bào)價(jià)是否合理、是否低于成本價(jià)的情況。與此同時(shí),在日趨激烈的建筑市場競爭中,一些發(fā)包單位為了減少投資而盲目追求低價(jià)中標(biāo),投標(biāo)人為了在競爭中生存,往往被迫將報(bào)價(jià)壓得過低。這種不健康的競爭行為,給建筑市場正常運(yùn)作帶來了很大沖擊。
為了進(jìn)一步規(guī)范建設(shè)工程招標(biāo)投標(biāo)的市場管理,合理降低工程造價(jià),維護(hù)工程建設(shè)發(fā)、承包雙方的經(jīng)濟(jì)利益,改變現(xiàn)行招標(biāo)投標(biāo)過程中一些無序競爭、大幅度壓低工程招投標(biāo)價(jià)格的現(xiàn)象,建設(shè)部令(第107號(hào))規(guī)定,施工圖預(yù)算、招標(biāo)標(biāo)底和投標(biāo)報(bào)價(jià)由成本(直接費(fèi)、間接費(fèi))、利潤和稅金構(gòu)成,并明確投標(biāo)報(bào)價(jià)不得
